Netflix akkoord met T-Mobile

There is an accord between net flix and t-mobile (Deutsche Telekom). EU law requires that customers from other EU countries are able to buy goods under the same terms as local customers. Here the terms in the Netherlands regarding Netflix are less than Poland or Germany as there is no Netflix app on the t-mobile tv-box. From reading the forum many customers are very disappointed.

Welcome to this T-Mobile community. Yes, you are obliged to acquire goods at the same conditions as local citizens. That means you may acquire goods and services at the same service level as local citizens. In this case; acquiring the same goods and services as offered by T-Mobile Netherlands to Dutch citizens. As you  mentioned T-Mobile does not offer a Netflix or other streaming service apps on its STB's. It may change in the future, but at this moment nothing is known about adding these apps to its platform. It's good you share your wish as the more customers let T-Mobile know it's wishes, the more change their policy changes towards adding streaming services. 

In between you could use a casting device to support Netflix on your device. 

Then I also have the right by European law to acquire the same product or service as a German citizen or a Polish citizen ...and therefore T-mobile Netherlands are lagging behind, unlike the Dutch telfort, the Dutch kpn, etc...it is not specific to the local citizen, it is specific to t-mobile Netherlands management.

In short t-mobile Netherlands are shooting themselves in the foot, from European-wide point of view and from a local point of view.

No, that's a wrong explanation of how this law is intended and works. T-Mobile is not obliged to offer the exact same services in each country. They are obliged to offer every of their customer the same level of service within a country within the scope of the law. Every country has it's own providers and therefor own services adjusted to the used techniques and markets. T-Mobile, nor any other provider, has a pan-European network. They have unique networks in several EU markets. In various countries they offer mobile only, and in some markets fiber or dsl services as well. There is not 1 proposition as there is not 1 european wide network nor 1 market. Not for T-Mobile, not for any other provider.

However, as a fellow customer I fully agree they should offer services as Netflix as it is requested by many. Not by law, but by demand.

 

“T-Mobile is not obliged to offer the exact same services in each country” No they don’t. There is no need to go in court either. If it is allowed to get T-mobile Magenta package from Germany, that would do. 

They are simply focusing on what they are not obliged to do, and not what they should..

As for the demand, counting that there are 449 questions on the site and it has been measured: https://community.t-mobile.nl/nieuws-345/winactie-win-gratis-netflix-met-je-magenta-gedicht-307635 there is no worry.

But from another point of view, there should be a court order: the company is discriminatory in a way.. Who’s the general manager for Netherlands?
